No, the cohabitant is not a legal heir. If you want your partner to inherit your assets, you must expressly mention this in your will or inheritance agreement.

Registering your last will and testament will allow you to :

  • Favour an heir, for example one of your children or your partner
  • Provide for heirs other than those provided for by law, such as your cohabitant

An executor will then take charge of settling the estate and dividing it up.

It is important to note, however, that a will does not deprive an heir of his rightful share of the estate.
